1. Scope and Seller

These Terms of Service apply to orders placed through noble11.com and to the use of the Noble11 online store.

A “consumer” is a natural person acting primarily outside their trade, business, or profession. Mandatory consumer rights in the customer’s country of residence remain unaffected.

2. Products and Store Information

We sell sunglasses and related accessories. We take reasonable care to describe products accurately.

Colors may appear differently depending on the screen and lighting, and measurements may vary slightly as stated on the relevant product page. Product images are illustrative unless expressly stated otherwise.

3. Ordering and Formation of the Contract

Product listings are invitations to submit an order and are not binding offers.

You may review and correct your cart and checkout information before placing the order. By activating the final order button that clearly indicates an obligation to pay, you submit a binding offer to buy the items in your order.

An automated order acknowledgement confirms that we received the order but does not necessarily constitute acceptance.

We accept your offer when we:

Send a shipping confirmation
Expressly confirm acceptance
Dispatch the goods

Whichever occurs first.

If an order contains several items, acceptance may occur separately for each item.

We may decline an order before acceptance, including because:

An item is unavailable
Payment authorization fails
Shipping is not reasonably possible
There is an obvious pricing or description error

If payment was already collected for an order we do not accept, it will be refunded.

The contract language is English.

We provide the order information and these Terms electronically. Shopify may also make order details available through your customer account or confirmation messages. Please save a copy for your records.

4. Prices, Taxes, and Payment

The price shown at checkout is the price payable for the order.

Prices include applicable VAT where the store indicates this or where required by law. Any additional charges will be displayed before you place the order.

Available payment methods are shown at checkout and may vary by country.

Payment is due when the order is placed unless the selected payment provider states otherwise. Payment services may be subject to the provider’s own terms and privacy policy.

For deliveries outside the customs territory from which the goods are shipped, the recipient may be responsible for import duties, taxes, or customs charges unless checkout expressly states that they are included.

Such charges are imposed by local authorities and are outside our control.

5. Promotions

Discounts and promotions are subject to the conditions displayed with the offer.

Unless stated otherwise:

Discounts cannot be combined
Discounts have no cash value
Promotions apply only during the advertised period
Promotions are subject to eligible stock availability

If a promotion provides a free or discounted item based on the purchase of other items, returning part of the qualifying purchase may reduce the refund by the value of the retained promotional benefit, to the extent permitted by law.

6. Delivery

We deliver to the destinations offered at checkout.

Current dispatch estimates, delivery estimates, costs, tracking information, customs information, and delay provisions are set out in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates unless we expressly agree to a binding date.

Statutory remedies for delayed delivery remain unaffected.

7. Title and Risk

Goods remain our property until paid for in full.

For consumers, the risk of accidental loss or damage generally passes when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

Different rules may apply if the consumer independently commissions a carrier not offered by us.

8. Returns, Withdrawal, and Refunds

The Return and Refund Policy, including the statutory withdrawal instructions and model withdrawal form, applies to eligible returns.

Nothing in these Terms limits mandatory cancellation, conformity, or warranty rights.

9. Conformity and Statutory Warranty

Products must conform to the contract and are covered by the mandatory statutory rights applicable to consumers.

Please include your order information and evidence of the issue so that we can provide an appropriate remedy.

Any voluntary manufacturer or commercial guarantee, if offered, is additional to and does not restrict statutory rights.

10. Store Accounts and Acceptable Use

You are responsible for keeping your login credentials confidential and for activity under your account.

Information you submit must be accurate and current.

You must not:

Misuse the store
Interfere with its operation or security
Introduce malicious code
Scrape the store in an abusive manner
Use the store unlawfully
Infringe the rights of others
Attempt unauthorized access

We may restrict access where reasonably necessary to protect the store, users, or our legal rights.

11. Intellectual Property

The Noble11 name, branding, website design, photographs, graphics, text, video, and other store content are owned by or licensed to us and are protected by intellectual-property laws.

You may use the store for personal, non-commercial shopping purposes.

No content may be reproduced, distributed, modified, or commercially exploited without permission, except where permitted by law.

12. Third-Party Tools and Links

The store may include links, integrations, or services provided by third parties.

Their own terms and privacy policies may apply.

We are not responsible for third-party content or services outside our control, without limiting liability that cannot lawfully be excluded.

13. Reviews and User Content

If you submit a product review or other content, it must:

Reflect a genuine experience
Not be unlawful
Not be misleading
Not infringe third-party rights
Not be abusive
Not contain another person’s personal data without permission

You grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and adapt submitted content for operating and promoting Noble11, to the extent permitted by law.

This does not transfer ownership of your content.

14. Liability

We are liable without limitation for:

Intent and gross negligence
Injury to life, body, or health caused by negligence
Liability under mandatory product-liability law
Liability where another mandatory rule requires it

For slight negligence, we are liable only for breach of an essential contractual obligation whose performance is necessary for the proper execution of the contract and on which the customer may regularly rely.

In that case, liability is limited to loss that was foreseeable and typical when the contract was concluded.

These limitations also apply to our legal representatives and agents.

Mandatory consumer rights remain unaffected.

15. Changes and Availability

We may change store features, product availability, and these Terms prospectively.

The Terms in effect when your order was placed continue to govern that order.

Material changes will be posted with an updated date.

16. Governing Law and Jurisdiction

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory protections available under the law of that country.

Mandatory rules regarding consumer jurisdiction apply.

Otherwise, where legally permitted and the customer is a merchant, public-law entity, or special public-law fund, the courts at our place of business have jurisdiction.

17. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless a mandatory rule requires otherwise.
